Town of Moraga and ISS Ready To Smooth Out the Bumps On Moraga Road

An agreement between the town and International Surfacing Systems is up for a vote at the next town council meeting.

An item on the Moraga Town Council’s April 27 meeting agenda may have citizens reading town staff reports this weekend instead of carving the Easter ham.

A proposed resolution between the Town of Moraga and International Surfacing Systems (ISS), to resurface Moraga Road between Buckingham Drive and Draeger Drive, will be up for approval.

Town Manager Jill Keimach said the agreement, if approved by the Town Council, will mean the road will be repaired within two weeks, ending a year’s long dispute between the ISS and the town.

In 2009, the road was resurfaced by ISS using a “rubber cape seal,” which almost immediately began to peel away. The construction work was deemed substandard. Instead of patch-work repair, the town said it would like the entire roadway resurfaced. Resolution of the problem stalled as the two sides differed over the exact method of repair and how much each party should pay.

“I feel good that we have been able to resolve this issue,” Keimach said Friday in a phone interview.

The resurfacing project’s cost, estimated at $110,000, will be split 50-50 between the town and ISS. A Cal Trans Force Account means both the town and the contractor will benefit if the final cost is lower than budgeted.

The Town of Moraga will pay an additional, estimated $45,000 for striping, once the resurfacing is complete. Two thousand dollars related to staff costs will also be paid by the town. ISS will give the town a one year guarantee on the work.

“The money will come out of the Measure J Fund, which can only be spent on roads,” Keimach explained. “The council will also be asked to fund the cost overrun of $35,550 on the past (2009) project.”

Keimach said the town council wanted this issue resolved and was pleased ISS agreed to share the costs.

“ISS feels they have gone above and beyond their legal obligation,” she said.  “Hopefully, this will be viewed as a good thing and the town will not be spending more staff and legal time on this in the future.”
