Merrick Trial Set for January 23

Stanley Middle School teacher to stand trial in the New Year

The trial of Stanley Middle School science teacher Michael Wade Merrick has been set to begin Jan. 23 at the Contra Costa County Court House in Martinez.

Merrick has been charged with 25 felony counts after allegedly conducting a sexual affair with a 14-year-old female student. He pled not guilty in November of 2010.

Merrick appeared to be in good spirits Thursday, smiling at the court after being led out of a jail holding area by a bailiff. After a brief conference with his attorney, Elizabeth Grossman, Merrick was asked by Superior Court Judge Brian Haynes if he would waive the time restrictions usually imposed for conducting a swift and speedy trial. Merrick agreed to do so, allowing more than 60 days to elapse before the trial will commence.

Grossman requested a ratings conference for Jan. 11, and said she will be delivering information for review to the court regarding Merrick's psychological evaluation and other supporting documents no later than the first week in January.

Deputy District Attorney Johanna Schonfield and criminal defense attorney Elizabeth Grossman both declined formal comment after Thursday's appearance.
