Merrick Case Pushed Back; DNA Results Pending

Stanley Middle School teacher Michael Merrick must wait until May 24 to learn the date of his preliminary hearing.

Contra Costa County Superior Court judge Clare M. Maier Tuesday moved the date to set Stanley Middle School teacher Michael Merrick's preliminary hearing to May 24, citing the wait for results of DNA analysis of an item from the teacher's office as cause for the delay.

Merrick, the 47-year-old teacher accused of 17 felony counts of lewd and lascivious acts with a minor student, listened quietly as Maier confirmed with a prosecutor and attorney representing "Jane Doe" that the DNA results were still pending.

Merrick has been held at the Martinez Detention Facility since his arrest Oct. 27. Investigators during tutoring sessions in July and August, and said he — many of them sexual in nature — in the course of a day.
